Sivakasi in Tamil Nadu is known for its manufacturing clusters on firecrackers and matches. The local economy of the area is largely dependent on firecrackers industry. It has led to tangible economic development and improved standard of living in the area. So far as child labour norms for hazardous industries like firecrackers industry are concerned, International Labour Organization (ILO) has set the minimum age as 18 years. In India, however, this age is 14 years. The units in industrial clusters of firecrackers can be classified into registered and non-registered entities. One typical unit is household-based work. Though the law is clear on the use of child labour employment norms in registered/non-registered units, it does not include household-based works. Household-based work means children working under the supervision of their parents/relatives. To evade child labour norms, several units project themselves as household-based works but employ children from outside. Needless to say that employing children saves the costs for these units leading to higher profits to the owners. On your visit to one of the units at Sivakasi, the owner takes you around the unit which has about 10–15 children below 14 years of age. The owner tells you that in his household-based unit, the children are all his relatives. You notice that several children smirk, when the owner tells you this. On deeper enquiry, you figure out that neither the owner nor the children are able to satisfactorily establish their relationship with each other. (a) Bring out and discuss the ethical issues involved in the above case. (b) What would be your reaction after your above visit?

तमिलनाडु में शिवकाशी पटाखा और दियासलाई निर्माताओं के समूहों के लिए प्रसिद्ध है। यहाँ की स्थानीय अर्थव्यवस्था अधिकांशतः पटाखा उद्योग पर निर्भर है। इसी से इस क्षेत्र का आर्थिक विकास हुआ है और रहन-सहन का स्तर भी सुधरा है। जहाँ तक पटाखा उद्योग जैसे ख़तरनाक उद्योगों के लिए बाल श्रमिक नियमों का प्रश्न है, अंतर्राष्ट्रीय श्रम संगठन (ILO) ने श्रम हेतु न्यूनतम आयु-सीमा 18 वर्ष निर्धारित की है। जबकि भारत में यह आयु-सीमा 14 वर्ष है। पटाखों के औद्योगिक क्षेत्र की इकाइयों को पंजीकृत तथा अपंजीकृत दो श्रेणियों में वर्गीकृत किया जा सकता है। घरों पर आधारित कार्यशालाएँ एक विशिष्ट इकाई है। यद्यपि पंजीकृत/अपंजीकृत इकाइयों में बाल श्रमिक रोजगार के विषय में कानून स्पष्ट है, घरों पर आधारित कार्य उसके अंतर्गत नहीं आते। ऐसी इकाइयों में माना जाता है कि बालक अपने माता-पिता व सम्बन्धियों की देख-रेख में कार्य कर रहे हैं। बाल श्रमिक मानकों से बचने के लिए अनेक इकाइयाँ अपने को घरों पर आधारित कार्य बताती हैं और बाहरी बालकों को रोजगार देती हैं। यह कहने की आवश्यकता नहीं कि बालकों की भर्ती से इन इकाइयों की लागत बचती है जिससे उनके मालिकों को अधिक लाभ मिलता है। आपने शिवकाशी में एक इकाई का दौरा किया, जिसमें 14 वर्ष से कम आयु के लगभग 10–15 बालक काम करते हैं। उसका मालिक आपको इकाई परिसर में घुमाता है। मालिक आपको बताता है कि घर-आधारित इकाई में वे बालक उसके सम्बन्धी हैं। आप देखते हैं कि जब मालिक यह बता रहा है, तो कई बालक खीस निपोरते हैं। गहन पूछताछ में आप जान जाते हैं कि मालिक और बालक परस्पर कोई सम्बन्ध संतोषजनक रूप से सिद्ध नहीं कर पाए। (a) इस प्रकरण में अंतर्ग्रस्त नैतिक विषय स्पष्ट कीजिए और उनकी व्याख्या कीजिए। (b) इस दौरे के बाद आपकी क्या प्रतिक्रिया होगी?
